We refer to our announcement on 15 November 2010 concerning PKNK’s Summons In Chambers dated 1 November 2010 for the determination of points or issues of law for the disposal of the case.
We wish to announce that the Company was informed by our solicitors that the Court was of the view that our claim is time-barred under the Public Authorities Protection Act (“PAPA”) or even if not under PAPA, then it is time-barred under the Limitation Act and as such our claim against PKNK was dismissed with costs.
The solicitors of the Company are of the view that the learned Judicial Commissioner erred in deciding that our claim is time-barred and advised an appeal to the Court of Appeal.
